The Dutch version of these Terms & Conditions is the legally binding version. The English version is provided for convenience. In the event of any discrepancy between the two versions, the Dutch version shall prevail.

These Terms & Conditions apply to all bookings made through Another Space.
Before making a booking, please read these Terms & Conditions carefully. By submitting a booking request and/or accepting a Booking Confirmation from Another Space, you agree to these Terms & Conditions, insofar as permitted by applicable law.
 
1. About Another Space
Another Space is a Dutch sole proprietorship providing location booking and brokerage services for photoshoots, film productions, events, pop-ups, PR activities and other commercial productions.

Another Space primarily serves business clients, including brands, agencies, production companies, photographers, filmmakers, PR agencies and other professional parties. Private individuals may also use Another Space's services on an occasional basis.
 
2. Definitions
For the purposes of these Terms & Conditions:
Another Space means Another Space, as identified above.
Booking means a reservation of a Location that has been confirmed by Another Space in writing by email.
Booking Confirmation means the written confirmation sent by Another Space to the Client confirming the Booking.
Client means any individual or legal entity making or requesting a Booking through Another Space.
Consumer means an individual acting outside their business or professional capacity.
Location means the location made available for Booking through Another Space.
Location Owner means the owner, tenant, operator or other party legally entitled to make the Location available.
Host means a person appointed by Another Space to provide on-site hosting, supervision or support where this service has been expressly agreed in advance.
Booking Date means the date and time specified in the Booking Confirmation.
 
3. The role of Another Space
Another Space acts primarily as a booking and brokerage service between the Client and the Location Owner.
Another Space facilitates:

  • the presentation of Locations;

  • availability checks;

  • communication between the Client and Location Owner;

  • the booking process;

  • Booking Confirmations;

  • payment processing;

  • relevant booking information;

  • communication up to and including the Booking Date; and

  • payment of the Location Owner following receipt of the Client's payment.

Another Space is not, unless expressly agreed otherwise in writing, the owner, landlord, operator or manager of the Location.
The Location is made available by the Location Owner.
 
4. Responsibilities of the Location Owner
The Location Owner remains responsible for matters relating to the Location itself, including, where applicable:

  • the physical condition of the Location;

  • the safety and suitability of the Location;

  • access to the Location;

  • location-specific permits and legal requirements;

  • the availability of the Location on the Booking Date;

  • facilities and amenities advertised or agreed for the Location;

  • defects or deficiencies at the Location; and

  • providing accurate and up-to-date house rules and Location information.

Another Space relies on the information provided by the Location Owner.
Another Space is therefore not responsible for information that has been provided incorrectly, incompletely or inaccurately by the Location Owner.
 
5. Making a Booking
A booking request submitted through the website, by email or through another communication channel does not automatically constitute a confirmed Booking.
Another Space first verifies availability with the Location Owner.
A Booking becomes definitive only when Another Space sends a Booking Confirmation to the Client by email.
A preliminary availability indication, quotation or informal communication does not constitute a confirmed Booking unless Another Space expressly confirms this in writing.
Once confirmed, the Booking is binding, subject to these Terms & Conditions and any mandatory statutory rights.
 
6. Prices and Another Space's commission
The Location Owner determines the base price of the Location.
Another Space charges a brokerage/service commission for its services.
The standard commission is:

  • 20% excluding VAT for standard Bookings; and

  • 30% excluding VAT where an Another Space Host is provided.

The price communicated to the Client may therefore consist of:

  • the Location Owner's Location fee;

  • Another Space's brokerage/service commission;

  • additional agreed costs; and

  • applicable VAT and other legally applicable taxes.

Another Space is transparent with Clients that its service fee/commission is included in the price communicated to the Client.
Specific Bookings may be subject to different pricing or commission arrangements if agreed in writing.
 
7. Payment
Payments are generally processed by Another Space.
Depending on the Booking, payment may be made:

  • through the Another Space website;

  • through the online payment system;

  • by invoice; or

  • under another payment arrangement expressly agreed in writing.

Photoshoots and film productions
Full payment is generally required in advance for photoshoots, film productions and similar productions.
An alternative payment arrangement may be agreed in writing.
Business clients
For B2B Bookings, Another Space may agree to a payment schedule under which at least 50% of the total Booking price must be paid before the Booking Date.
The remaining amount may be invoiced after the Booking Date where agreed.
The standard payment period for the remaining balance is 14 to 30 days, unless another payment period has been expressly agreed.
Events
For events, a 50% deposit is generally required.
The remaining balance must be paid within the agreed payment period.
A Location Owner may require a different payment schedule for a specific Location. Any such arrangement must be communicated and agreed before the Booking is confirmed.
If the required advance payment has not been received, the Booking may not proceed.
 
8. Payment to the Location Owner
Another Space pays the Location Owner the agreed Location fee after Another Space has received the corresponding payment from the Client, unless otherwise agreed with the Location Owner.
The Client's payment obligation to Another Space remains separate from the payment relationship between Another Space and the Location Owner.
 
9. Business clients and consumers
Another Space primarily operates on a B2B basis.
Where a Client acts in the course of its business or profession, the Booking is treated as a business transaction.
Where a Client qualifies as a Consumer, applicable mandatory consumer protection legislation applies.
Nothing in these Terms & Conditions is intended to exclude or restrict any statutory consumer right that cannot legally be excluded.
 
10. Cancellation by the Client
A confirmed Booking constitutes a binding reservation.
Cancellation by the Client may therefore result in cancellation charges.
Cancellations must be submitted to Another Space in writing by email.
B2B cancellation policy
Unless different cancellation terms have been agreed for the specific Booking, the following cancellation charges apply to business clients:

These cancellation charges reflect, among other things, reserved Location capacity, administrative and brokerage work, loss of availability and potential loss of income for the Location Owner and Another Space.
Location-specific cancellation terms
Certain Locations, events or productions may have different cancellation conditions.
Where such conditions have been clearly communicated to and accepted by the Client before the Booking is confirmed, those specific conditions will apply.
Consumers
For Consumers, cancellation terms apply only insofar as they are permitted under mandatory applicable consumer law.
Where statutory consumer rights provide for a different cancellation or withdrawal arrangement, those statutory rights prevail.
 
11. Changes and rescheduling
A Client does not automatically have the right to change the Booking Date, time or Location.
Another Space may facilitate a request to change a Booking.
A change is only effective once:

  1. the Location Owner has approved the change;

  2. the requested alternative is available; and

  3. Another Space has confirmed the change in writing.

A change may result in a change to the Booking price.
 
12. Cancellation by the Location Owner
A Location Owner that has confirmed a Booking is expected to make the Location available on the agreed Booking Date.
If a Location Owner cancels a confirmed Booking without a valid reason, Another Space will inform the Client as soon as reasonably possible.
Another Space may attempt to find a suitable alternative Location.
If no suitable alternative is available or accepted by the Client, amounts paid for the affected Booking will, in principle, be refunded in full.
A Location Owner may need to cancel because of circumstances beyond its reasonable control, such as:

  • serious illness;

  • fire;

  • significant water damage;

  • unexpected damage to the Location;

  • safety issues;

  • government measures;

  • unexpected legal restrictions; or

  • other circumstances that could not reasonably have been prevented.

Where the Location cannot be provided as a result, the Client will in principle receive a refund for the affected Booking if no alternative is accepted.
Another Space is not liable for additional or consequential costs incurred by the Client as a result of a Location becoming unavailable, including travel, accommodation, crew, production or other costs, to the extent permitted by law.
 
13. Cancellation by Another Space
Another Space may cancel a Booking where:

  • required payment has not been received;

  • the Location is no longer available;

  • the Booking cannot lawfully be performed;

  • the Client has provided incorrect or misleading information;

  • the intended use is unlawful, unsafe or contrary to the Location's house rules;

  • necessary permits are unavailable;

  • circumstances of force majeure apply; or

  • Another Space cannot reasonably be expected to perform the Booking.

Where a cancellation is attributable to Another Space itself, Another Space will inform the Client and, where appropriate, refund amounts received for the affected Booking.
 
14. Consumer withdrawal rights
Where the Client qualifies as a Consumer, statutory withdrawal rights may apply to an online agreement.
Whether a withdrawal right applies depends on the nature of the service and the applicable statutory exceptions.
Services relating to a specific date or period may fall within an exception to the statutory withdrawal right.
Another Space will provide Consumers with the information required by applicable law regarding withdrawal rights and any applicable exceptions.
Nothing in these Terms & Conditions is intended to limit mandatory statutory consumer rights.
 
15. Use of the Location
The Client may only use the Location for the purpose for which it was booked.
The Location may not be used for:

  • unlawful activities;

  • activities for which the required permission has not been obtained;

  • activities that create unreasonable risks to people or property;

  • activities contrary to the Location's house rules;

  • activities exceeding the agreed capacity; or

  • activities requiring permits that have not been obtained.

The Client is responsible for all persons attending the Location on behalf of or with the permission of the Client.
 
16. House rules
The Location Owner is responsible for providing Another Space with correct and up-to-date house rules.
Another Space will communicate the relevant house rules provided by the Location Owner to the Client.
The Client is responsible for complying with the house rules and ensuring that its employees, guests, crew, suppliers and other attendees comply with them.
Another Space is not responsible for house rules that were supplied incorrectly, incompletely or inaccurately by the Location Owner.
 
17. Photoshoots and film productions
For photoshoots, film productions and similar productions, the Client is responsible for:

  • its own equipment;

  • crew;

  • models;

  • suppliers;

  • styling;

  • props;

  • sets and decorations;

  • production activities;

  • required permissions and permits;

  • compliance with house rules; and

  • damage caused by the production or persons involved in it.

The Client must leave the Location in the condition in which it was found at the beginning of the Booking, except for normal wear and tear and any changes expressly agreed in advance.
 
18. Events
The Client is responsible for the organisation and execution of its event.
This includes, where applicable:

  • guests;

  • staff;

  • security;

  • catering;

  • entertainment;

  • suppliers;

  • equipment;

  • event-specific permits;

  • compliance with applicable laws and regulations; and

  • compliance with the Location's maximum capacity.

The Client may not exceed the maximum capacity specified for the Location.
 
19. Permits and legal requirements
The party organising or carrying out a particular activity is responsible for obtaining the permits, permissions and approvals specifically required for that activity.
Another Space is not responsible for obtaining permits on behalf of the Client unless this has been expressly agreed in writing.
The Location Owner remains responsible for permits and legal requirements relating specifically to the Location itself, insofar as these fall under the Location Owner's responsibility.
 
20. Client responsibility
The Client is responsible for:

  • proper use of the Location;

  • its employees, guests, crew and suppliers;

  • compliance with the Location's house rules;

  • timely payment;

  • providing accurate information about the intended use of the Location;

  • obtaining permits required for the Client's activities; and

  • damage caused by the Client or persons under the Client's responsibility.

 
21. Location Owner responsibility
The Location Owner remains responsible for:

  • the physical condition of the Location;

  • the safety of the Location;

  • Location-specific legal requirements;

  • making the Location available as agreed;

  • access to the Location;

  • the accuracy of Location information;

  • providing correct and current house rules;

  • Location-specific permits; and

  • defects or deficiencies relating to the Location.

Another Space does not assume these responsibilities unless expressly agreed otherwise in writing.
 
22. Responsibility of Another Space
Another Space is responsible for its own brokerage and booking services, including:

  • processing the Booking;

  • communication carried out by Another Space;

  • passing on relevant information provided by the Location Owner;

  • processing payments;

  • administrative handling of the Booking; and

  • paying the Location Owner in accordance with the agreed arrangements.

Another Space is not responsible for obligations that exclusively belong to the Client or Location Owner.
 
23. Responsibility on the Booking Date
From the moment the Client enters the Location on the Booking Date, responsibility for the physical circumstances at the Location rests with the Location Owner, unless an Another Space Host has expressly been agreed.
If Another Space is not physically present at the Location, Another Space cannot supervise what takes place there and is not responsible for events, damage, loss or incidents occurring at the Location, except to the extent mandatory law provides otherwise.
 
24. Another Space Host
An Another Space Host is only provided where this has been expressly agreed in advance.
Where an Another Space Host is provided, the applicable Another Space commission is 30% excluding VAT, unless otherwise agreed.
Depending on the agreed Host service, the Host may:

  • receive the Client;

  • provide an introduction to the Location;

  • explain the house rules;

  • provide on-site supervision;

  • remain available during the Booking;

  • close the Location after the Booking; and

  • conduct a visible damage check after the Booking.

The responsibility of Another Space when a Host is provided is limited to the specific Host services agreed.
Providing a Host does not make Another Space the owner, landlord or operator of the Location.
Another Space remains responsible only for the agreed Host services and does not automatically assume responsibility for structural defects, building safety, Location-specific legal requirements or other matters that remain the responsibility of the Location Owner.
 
25. Damage and damage claims
The Client is responsible for damage caused during the Booking by:

  • the Client;

  • employees;

  • guests;

  • crew;

  • suppliers;

  • models; or

  • any other persons attending the Location on behalf of or with the permission of the Client.

Damage to the Location or to property belonging to the Location Owner is handled directly between the Client and the Location Owner.
Another Space is not a party to a damage claim between the Client and Location Owner unless Another Space has expressly agreed in writing to take on an additional role.
Where Another Space or an Another Space Host was not physically present at the Location, Another Space cannot be held responsible for damage, loss or incidents occurring at the Location, except where mandatory law provides otherwise.
Damage claims should, where possible, be supported by photographs, videos, quotations, invoices or other relevant evidence.
Where a Host has expressly been assigned to conduct a final inspection, the Host may record and report visible damage. Recording or reporting damage does not make Another Space liable for the damage itself.
Any deposit or security deposit is Location-specific and will be communicated to the Client before the Booking.
 
26. Personal belongings
Another Space is not responsible for loss, theft or damage to belongings of the Client, its employees, guests, crew, suppliers or other persons present at the Location, except where liability cannot legally be excluded.
The Client remains responsible for the safe storage of its own belongings.
 
27. Liability of Another Space
Another Space is responsible only for direct damage to the extent that such damage is the direct result of a demonstrable failure by Another Space to perform its own agreed services properly.
Another Space is not responsible for damage or deficiencies caused by:

  • the Location Owner;

  • the physical condition of the Location;

  • defects at the Location;

  • incorrect information supplied by the Location Owner;

  • the Location becoming unavailable due to circumstances attributable to the Location Owner;

  • third parties; or

  • the Client.

To the maximum extent permitted by law, Another Space is not liable for indirect or consequential damage, including lost revenue, lost profits, missed productions, reputational damage or other consequential losses.
Nothing in these Terms & Conditions excludes liability that cannot legally be excluded under mandatory law.
 
28. Force majeure
Another Space is not liable for failure to perform an obligation where performance is prevented by circumstances beyond its reasonable control.
Force majeure may include:

  • payment system failures;

  • internet or communication failures;

  • government measures;

  • natural disasters;

  • extreme weather;

  • fire;

  • war;

  • strikes;

  • pandemics;

  • serious illness; or

  • other unforeseen circumstances that could not reasonably have been prevented.

Where a Location becomes unavailable due to force majeure, Another Space will inform the Client as soon as reasonably possible and will make reasonable efforts to find an alternative Location.
If no suitable alternative is available or accepted, amounts paid for the affected Booking will in principle be refunded.
Another Space is not liable for additional or consequential losses resulting from force majeure, to the extent permitted by law.
 
29. Complaints
Complaints concerning Another Space's services must be submitted in writing by email to:

Complaints concerning the physical condition of the Location, facilities, access or other Location-specific circumstances should be reported as soon as possible and, where reasonably possible, within 48 hours after the Booking.
This 48-hour period does not apply to defects or circumstances that could not reasonably have been discovered within that period.
Clients are encouraged to provide photographs, videos or other relevant evidence when submitting a complaint.
Another Space may facilitate communication between the Client and Location Owner but is not a party to disputes that solely concern damage, physical defects or other obligations of the Location Owner.
 
30. Privacy
Another Space processes personal data in accordance with applicable privacy legislation and its Privacy Policy.
Personal data may be processed for purposes including:

  • processing Bookings;

  • communication;

  • payment processing;

  • administration;

  • customer service;

  • performance of agreements; and

  • legal obligations.

The current Privacy Policy is available on the Another Space website.
 
31. Images and intellectual property
The Client remains responsible for obtaining all necessary rights, permissions and consents relating to photographs, videos, music, trademarks, models, guests and other materials used during a production or event.
The Client is responsible for obtaining the necessary consent from persons who are photographed or filmed during a production, including models, guests, employees and other attendees.
All texts, designs, trademarks, logos, photographs and other materials created or supplied by Another Space remain the property of Another Space or its licensors unless otherwise agreed in writing.
 
32. Changes to these Terms & Conditions
Another Space may update these Terms & Conditions from time to time.
For an already confirmed Booking, the version applicable at the time the Booking was confirmed will generally continue to apply, unless a change is legally required or otherwise agreed with the Client.
The most recent version will be published on the Another Space website.
 
33. Applicable law
These Terms & Conditions and the agreement between Another Space and the Client are governed by Dutch law.
Where the Client is a Consumer, this choice of law applies only to the extent permitted by applicable law and does not affect mandatory consumer protection rights that cannot legally be excluded.
 
34. Disputes
Another Space and the Client will first attempt to resolve any dispute amicably.
If a dispute cannot be resolved amicably, it may be submitted to the competent court in accordance with applicable law.
For Consumers, the applicable statutory jurisdiction rules apply.
 
35. Language
These Terms & Conditions are available in English and Dutch.
In the event of a conflict between the English and Dutch versions, the Dutch version shall prevail, to the extent permitted by law.

Agreement to the Terms & Conditions
By submitting a Booking request and/or accepting a Booking Confirmation, the Client confirms that they have had the opportunity to read these Terms & Conditions and agree to them, to the extent permitted by applicable law.

For online bookings, the Client must actively confirm acceptance of the applicable Terms & Conditions before completing the Booking.
